Qualification Requirements

In order for you to be able to submit your immigration application through Employer Job Offer: International Student Stream, you must have a job offer from an eligible Ontario employer who meets the following factors:

  • it must be an offer of full-time, indefinite-term employment in an occupation that is listed in the National Occupational Classification (NOC) and corresponds to Level 0, A or B;
  • provides payment for work performed at least equal to the provincial minimum wage for that specialty and location.

As an immigrant worker, you are obligated to:

  • Meet all the criteria required in order to:
    • obtain an education or diploma from a certified Canadian institution of higher education with a term of 2 years or more of full-time education, or
    • obtain an education, diploma or certificate from a Canadian accredited post-secondary institution with a minimum of 1 year of full-time education, provided that this improvement in qualifications is attached as a prerequisite for the existence of the specialty.
  • Complete at least half of the full-time course of study and legally reside and study in the country
  • Submit the immigration application within 2 years from the date of obtaining the required education and obtaining the necessary educational documents. The OINP system states that this date corresponds to the date indicated on your certificate or diploma from the university. Or, if you do not yet have such documentation, the date of the official letter from the institution where you studied, in which the date of issuance of this educational document will be written, is taken into account;
  • Seek to reside in that province;
  • If you live in the country, you need to have the legal status of a person who lives in the country continuously (this includes study permits, work permits, temporary resident status).

Important Note!

You should not submit your OINP immigration application during your last academic term. Applicants must already have the required educational level, certificate or diploma when submitting their immigration application.

You (the immigrant applying) and/or your family members must not own the employer’s business share, either currently or previously. The exception is if you received such a share as part of the payment to you as a worker, and your combined share of the capital and part of your relatives is no more than 10%.

Your provincial employer must also meet the following requirements:

  • Have been active in their business for at least 3 years;
  • Own an office in Ontario, where you will work;
  • Comply with all laws and all local requirements as for the Employment Standards Act and the Occupational Health and Safety Act.

Provided you are employed in the Greater Toronto Area, your employer must meet the following requirements:

  • Receive at least $1,000,000 in gross annual income for the most recent fiscal year;
  • 5 full-time employees who are citizens or permanent residents in the territory where you will be working.

Provided you are employed outside of the Greater Toronto Area, your employer must meet the following requirements:

  • receive at least $500,000 in gross annual income for the most recent fiscal year;
  • 3 full-time employees who are citizens or permanent residents in the territory where you will be working.

A full-time, indefinite-duration job offer is a definite job offer without a definite date of employment, and provides for working at least 30 hours per week and from 1,560 hours for a period of 1 year.

A job offer may not be given in order to obtain a position, which:

  • is a seasonal or part-time position, despite the number of hours worked;
  • is performed by a subcontractor, contractor, and agent.
